How to send a takedown notice
If you believe that material on ClipX infringes your copyright, send a written notice by email to [email protected]. Your notice must include all of the following:
- Your physical or electronic signature, as the copyright owner or as a person authorized to act for the owner.
- Identification of the copyrighted work that you claim is infringed. If the notice covers several works, give a representative list.
- Identification of the material that you claim is infringing, with enough information for us to find it. Give the ClipX URL of each item, for example
https://clipx.io/c/…. - Your contact information: name, postal address, telephone number and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for the owner.
We may not act on a notice that does not include these elements.
What we do when we receive a valid notice
- We remove the material or disable access to it promptly.
- We tell the user who posted the material that we removed it.
- We keep a record of the notice for our repeat-infringer policy.
How to send a counter-notice
If we removed your material and you believe that this was a mistake or a misidentification, you can send a counter-notice by email to [email protected]. Your counter-notice must include all of the following:
- Your physical or electronic signature.
- Identification of the material that we removed or disabled, and where it appeared before we removed it (the ClipX URL).
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of a mistake or a misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the US Federal District Court for the judicial district of your address (or, if your address is outside the United States, any judicial district in which ClipX can be found), and that you will accept service of process from the person who sent the original notice, or from that person's agent.
When we receive a valid counter-notice, we send a copy to the person who sent the original notice. We restore the material in 10 to 14 business days after we receive the counter-notice, unless that person tells us first that they have filed a court action to stop the infringement.
Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who are the subject of repeated valid copyright notices.
False claims
Under 17 U.S.C. § 512(f), a person who knowingly misrepresents that material is infringing, or that material was removed by mistake, can be liable for damages, including costs and attorneys' fees. If you are not sure that material infringes your copyright, get legal advice before you send a notice.
